GAIN Capital secures Swiss Court approval for deposition in OANDA patent infringement case
GAIN Capital has secured the approval of Swiss Court for judicial assistance in a patent infringement lawsuit brought by OANDA.
On June 17, 2025, GAIN Capital Holdings, Inc. and GAIN Capital Group, LLC provided an update on the matter to the New Jersey District Court.
The High Court of Zurich and the Federal Office of Justice (FOJ) have approved GAIN’s Letter of Request to take the deposition of Richard Olsen in Switzerland.
Plaintiff OANDA Corporation sued Defendants GAIN Capital Holdings, Inc. and GAIN Capital Group, LLC for alleged infringement of two United States Patents directed to trading currencies over a computer network.
GAIN seeks evidence and testimony from a listed inventor on the patents, Dr. Richard Olsen, to support its defenses of patent invalidity and patent unenforceability, and to rebut OANDA’s claim for damages in the ongoing proceedings and at trial.
Dr. Olsen has to provide testimony about the asserted patents to address matters directly relevant to the case.
GAIN is conferring with OANDA’s counsel on dates for the deposition to ensure it is taken promptly.
